RESTRICTIONS AND-EASEMENTS
_ KNOW A!L MEN BY THESE PRESENT, that the undersigned,
TARPON,6AY VILLAS, a,Flori~a-Partnership, (Developer) having a
contract- to purchase ]and by Parce-1", all of the Parcels being
- included in the following described plat: -
A~3 of the "Tarpon Bay Villas: according;to the
- plat thereof as recorded in Plat-Book ~ _
at pages f~ of the Public Records of-St.
Lucie County., _Florida,- a copy of said plat being _ -
- "attached hereto as Exhibit - - .
makes the follows-ng Declaration of Covenants, Restrictions and
Easements which shall extend to, attach to, cover and run with
each Parce-1 only from the -date Developer becomes-the owner-of
each Parcel and shall be binding upon the undersigned and upon _
all-persons deriving title through the undersigned as to each
Parcel from the date .Developer .becomes the owner of each Parcel.
This Declaration shall be for the benefit ~f and limitations
upon the Developer and all future owners of real property in
aTarpon Bay Yillas" whose .title is derived through the Developer.
Each Parcel described above, from -the date of purchase of each- _ -
of each Parcel by the Developer before or after the recording of _
this Declaration in the-Public Records of St. Lucie Gounty,
Florida, is and sha ll be held, transferred, sold, conveyed and
occupied subject to the covenants, restrictions, easements,
charges and liens (sometimes referred to as "Covenants and
Restrictions"),hereinafter set forth.
Until .any Parcel shown on the. Plat attached hereto is
purchased oy-the Developer it cannot become subject to this
Declaration, -
In the event any portion of the land contained within
the boundaries of t~~ Plat is re-platted, the re-platted land is
not subject to this-Declaration ~f Covenants, Restrictsons and
