Easements unless expressly adopted and accepted in writing by the
Developer,-its successors or-assigns-' and the recording of-this
acceptance in the Public Records of the Gircuit Court of St.
Lucie County, F1Arida.-- ~ ~ -
_ ARTICLE I -
- OEFINItIONS -
A. "Association" shall mean and refer to The Tarpon Bay -
Vi11as Nomeowners~Association, Inc., a Florida corporation not - -
for profit. - ~ -
- 6. "Developer" shall mean and refer to Tarpon bay Villas,
a Florida:partnership, its successor, assignee or designee. - -
:C, "Tarpon Bay Villas" or "Property" shall"mean and refer
to al l such existing properties and additions -thereto, as are - -
subject to this Declaration or any supplemental or amended Declar- - -
ation. - - - = - -
- D. "Parcel" shall mean and refer to any parcel-of land -
in Tarpon Bay Villas, together Frith any and all _improvements
thereon, platted in the Public.Records of Palm Beach County , -
Florida, on-which a residential structure could be constructed
whether or not one has been constructed. Common Areas as~-.here- -
inafter defined are not included in this definition of Parcel.
= - E. "Owner" shall mean and refer to the record fee simple _
owner, whether one or more- persons or entities., of -the -fee simple - l-
titie to a Dwelling Unit which is a part of The Property; including
contract sellers (but not contract purchasers) and Developer. (It
shall-not have any reference to the seller from whom Developer has
a .contract to purchase Parcels of land.) -
F. "C-oma~on Area" shall mean- and refer to those areas of
land and such personal property which-the Association and/or the
Developer owns or in which the Association has art interest, in-
eluding, without limitation, a right of use, and in which every -
Owner of a Dwelling Unit shall have a right of enjoyment which
shall pass with the title to every Parcel or Dwelling Unit. -
G. ~Townhome" shall mean and-refer to a single family -
Dwelling Unit attached to one or ®are other single family 13we1]ing -
