Creation of the lien and Personal Obligation of Assessments. - The Developer for each- Dwelling Unit owned by it within "Tarpon Bay - Villas" hereby cove~~ants and each Owner of any. Dwelling Unit by accept- ance of a~deed therefor, whether or not it shall be so expressed in - any~such deed-or other-conveyance; including any purchaser at a - 3udicial sale, is deemed to conversant and agree to pay to the Ass-- _ ociation; annual assessments or char es as g provided herein; (2.) special assessments for capital improvements, such-assessments to be fixed, established, and collected from time to time-as hereinafter provided. Only Dwelling Units_sha11 be assessed and the assessment shall commence. only after a certificate of occupancy is issued for the Dwelling Unit. The. annual and special assessments, together with interest thereon at the rate of ten-percent (10~) per annum and costs of collection_thereof (including reasonable attorney's fees shall be a charge on the land and shall be a continuing lien - upon the property against.which each such assessment is-made until- - paid. Each such-assessment, together with such interest thereon and cost of collection thereof as hereinafter provided, shall also be the personal obligation of the per-son who was_the Owner of such property at'the time when the assessment fell due. 8. Purpose of Assessment. The annual and special .assessments levied by the Association shall be-.used exclusively for the impr-ove- ment and maintenance of the-Common Area, including., but not limited to, the cost of taxes, labor,-equipment, materials, management, main- tenance and supervision thereof, cost of a master television system, cost of all insurance (liability, workmen's compensation, medical, fire,-windstorm, flood or any of these that the Board-of Directors _ n;ay -from time to time determine to be necessary); as well as for such other purposes as .a re permissable activities. - - C.
