GENERAL-PROVISIONS
-1, Duration-and Remedies for Violation. The Covenants,.
-Restrictions and Easements of. this Declaration shall run with
and bind the property., and shall inure to the benefit of and be
. enforceable by the Developer, the Association or-the Owner of
any Property subject to this Declaration, their respective legal
.representatives,_heirs; successors or assignes, fflr a term of .
fifty (50) years from the date tfiis Declaration is recorded,
- after which time said Covenants, Restrictions and Easements
shall automatica:lty be extended for successive periods of tern -
-(10) years un-less an instrument signed by the then Owners of - -
two-thirds (2/3) of the Dwelling Units has been reco"rded, -
agreeing to change or terminate said Covenants, Restrictions. -
and Easements in whole-or in part. At any time during an~
automatically extended -period, a docume~it-~greei ng to the
change may. be recorded and is effective as of the date of
recording. This portion of-this section concerned with. change
or termdnation by a-two=thirds (2/3) vote of-Owners-shall_:fiave
no application so long as Developer shall-be the owner-of one
. Parcel or one Dwelling-Unit of- any Property affec~red by~-tFis
Declaration, or for a period of five years from the date of
the recording in the Public Records -of St. Lucie County, .
Florida of ~this.Declaration of Covenants ,.Restrictions and - _
Easements, whichever event first occurs. .
2. Enforcement. Violation_or breach of any condition, =
covenant or restriction herein contained shall give the`Devel-
oper and/or Association and/or Owner(s) in addition to all
other remedies, the right to proceed at law~or.in equity to
compel a compliance with the terms of said conditions, ~t~ven-
ants or restrictions., and to prevent the violation or breach
of any .of their, and the expense of such litigat-ion shall be
borne by the. then Owner or Owners of the subject property, -
provided such proceeding results in a findsng that such Owner-
was in violation of said Covenants or Restrictions. Expenses
of litigation shall ir.~lude reasonable ettorney's fees incurred -
