That Grantor, for and in consideration of the sum of TEN (:10.00)
DOLLARS and other good and valuable- consideration paid by Grantee, the
receipt of which is hereby acknowledged, has granted, bargained, :and sold to
Grantee and Grantee's heirs and assigns forever the following described real
property situated, lying and being in. St. Lucie County, Florida, Lo wit:
- The Condominium Parcel known as Apartment 12 2 -B of
Phase ~ of HIGH POINT OF FORT PIERCE CANDOMINIUM
SECTION II (the "Condominium") according to-the Declar~-
tion of Condominium thereof, recorded ' C?fficial Records
- g~k 340 at Pages 1396 ~uqh ~0 of the Public
-Records St. Lude -County, Florida as such Declaration
may have_ been- amended by any amendments ,thereto
hereto flied in- the Public Records of St. Lude County, -
Florida including, but not limited to, any amendment to
add -the aforesaid Phase to the Condominium (if such -
Phase - be other than Phase I thereof) .
Grantee, by acceptance hereof, and by agreement with Grantor hereby -
il expressly assumes -and agrees to be _ bound by and to comply with all of the -
covenants, terms, conditions and provisions set forth and contained in the
aforedescribed Declaration of Condominium, including, but not limited to, the
obligation to make payment of assessments for the maintenance and operation - -
of .the. Condominium which may be levied against the above described Apart-
ment. Grantee expressly acknowledges the existence ~ of a Settlement Stipula-
tion and Agreement- for and Grant of Easements -and Other Rights (the "Settle-
meet Stipulation") and a Declaration of Protective Covenants and Restrictions -
(the "Protective Covenants"), as hereinafter set forth. -The- Settlement Stipu- -
lation -provides. for this Condominium to beserved by certain fadlities of High
Point of Fort Pierce -Condominium Section 1 and the Protective - Covenants
provides for certain land use covenants upon the land areas described therein
(including, but not limited to, portions of the land areas included within this
Condominium) and . provides for certain drainage easeanents and other ~ ease-.
manta and ,rights including, but not - linnited tr= the "Roadway Easement",
- "Sewage System Rights" , "Water System Rights" - and "Future Development'
Property Drainage Easement", all as are-more particularly described- therein, _
all in addition - to- the -other matters set forth in the Settlement Stipulation and
Protective Covenants, which a~ther matters include, but are not limited to, the
obligation to pay certain "Assessments" as are respectively -set- fo**~± i-*± *~p
Settlement Stipulation and Protective Covenants . Grantee expressly acknowl-
edges and assumes the obllgatton to pay the amounts assessed against the
Apartment under both the Settlement Stipulation and Protective Covenants .and
. acknowledges that "Assessments" under both the Se ant Stipulation and -
. Protective Covenants against all properties nova or hefter included within
