That I am the owner of the property located at 708 North U.S.~1, Fort Pierce, Florida and legally described as follows: That part of Lot 14 FULTZ'S~RESUBDIVISION OF RESUBDIVISiON of Block 2 of DITTMAR'S ADDITION to Edgartown according to the Plat as recorded in Plat-Book 3 at Page. 36 of the Public Records of St.Lucie County,Florida in Section 3,TownBhip 35 3outh,Rang~ 40 East described as followss.8eg.in at the Southeast corner of said Lot 14,thence Westerly along South - line of Lot 14 a distance of 89.5 feet thence North 00° 00'.37" East a distance of 58.88 feet thence South 89°58' 58"East a distance of 70.02 feet to the East line of said Lot l4,thence Southeasterly along the East line of said Lot 14 to the Point of Beginning.. 2. That I am also the Lessor who executed that certain Lease dated August 1, 1978 between Gary and Yvonne Jackson as Lessor and Phyllis E. Dietlin as Lessee leasing the above-described premises for $75.00 per month, said Lease recorded in O.R.Book 293 at Page 2306 of the Public Records of St.Lucie County, Florida. - 3. The structure which was located on the above-said premises was burned on September 15,1978 and was rendered at that time incapable of use for commercial business and was further burned to the ground in December of 1979. 4. The property is not occupied or being used by anyone at this time and further of my own personal knowledge, Phyllis E. J Dietlin has never occupied said premises nor has she. used said \ premises under the above-described. Lease nor has she paid any money under the above-described Lease, but in fact said Lessee,Phyllis E. Dietlin, was in default on August 1,1978 and the Lessor has since re-entered and retaken possession of the devised premises. 5.
