ORDER ON PRE-TRIAL CONFERENCE
. This Pre-Trial Conference having been held, it is
hereby ORDEREII AND ADJUDGED: -
1. STIPULATION AND ADMISSIONS:
(a) Venue is properly in Ft. Pierce,~St. Lucie
County, Florida.
(b) The execution of the contract attached to
First Amended Canplaint as Exhibit A by the City of Fort Pierce.
- (c) Plaintiff DEPARTMENT OF TRANSPORTATION is
and at all times material was an. agency of the State of Florida.
(d) Defendant CITY OF FORT PIERCE-is a municipal cor-
f~ poration with its principal place of business in St. Lucie
County, Florida.
- (e) Defendant FORT PIERCE UTILITIES AUTHORITY in its
official capacity and pursuant to the contract referred to in
1. (b) above, applied for and obtained the Utility Permit -
indicated as Exhibit "B" of Plaintiff's First Amended Complaint.
(f) There was separation of the joint in the waterpipe
which caused sane damage to the structure which is the subject
of the instant action.
2. EVIDENCE:
Documentary and other evidence listed and presented
at Pre-Trial Conference shall be admitted into evidence without
