THIS CAUSE having come before the undersigned on January
28, 1980, upon Defendant's Motion to Strike Plaintiff's Motion _
for Summary Judgment, Defendant's Motion for Leave to Amend, -

Defendant's Motion to Compel, Defendant's Motion to Amend Third
Request to Produce by Interlineation, and: Plaintiff's objections
thereto, and having heard argument of counsel and being otherwise
advised in the premises, it is accordingly
ORDERED and ADJUDGED as follows: -
1. The Motion to Strike Plaintiff's Motion for Su®mary
Judgment is granted;
2. The Motion for Leave to File Second Amendment to
F !Counterclaim is granted;
3. Defendant/Counterclaimant's ore tenus motion to
amend Third Notice to Produce so as to reflect that only Plaintiff s
tax returns for 1978 are sought is granted;
4. Plaintiff's objections to Defendant's Third Notice
to Produce, as amended, are denied and Plaintiff shall have
thirty days within which to furnish the items .requested-therein;
5. Defendant's Motion to Compel is granted and Plaintiff
shall have twenty days within which to serve full and adequate
answers to interrogatories 48 and 50 upon pain of sanction;
