THIS CAUSE came on for consideration upon Defendants' =
Motion to Dismiss, Plaintiff's Motions to Strike and Defendants'
Motion for Protective Order and this. Court having considered the
arguments of counsel and being otherwise fully advised in the
premises, it is
ORDERED AND ADJUDGED that .Plaintiff's. Motion to Strike '
Defendants' Motion to Dismiss is granted, and the Defendants
Fort Pierce~Jai Alai, Inc,, Geraldine Ashton, Dave Brooks and
St. Paul Fire & Marine Insurance Company are directed to file
an Answer to .Plaintiff's Second Amended Complaint within 10 days
- of this Order, and it is
ORDERED AND ADJUDGED that Plaintiff's Motion to Compel
Discovery is granted as~to the Interrogatories served on the
Defendants Bartlett, Brooks, Fort Pierce Jai Alai, Inc. and
Ashton with the original Complaint filed in this action. Those
defendants shall have 30 days from the date of this Order to
supply the answers to the aforementioned Interrogatories. Failure
on the part of the defendants to supply answers to the aforemen-
tioned Interrogatories shall subject those defendants to the con-
tempt power of this Court and to other appropriate Sanctions.
DONE AND ORDERED in Chambers at Fort Pierce, St. Lucie
County, Florida, this day of - 1980.
