THIS CAUS$ having come before the undersigned o fiber
29, 1980, upon the Plaintiff's Motion to Strike, Plaintiff's
Motion Ore Tenus for Leave to Serve Second~Amended Complaint, and
Defendant's Motion for Rehearing, it is accordingly,
ORDERED and ADJUDGED as follows:
jj 1. Plaintiff's Motion to Strike is denied;
2. Plaintiff's Motion Ore Tenus for Leave to Serve

Second Amended Complaint is granted and Plaintiff shall have
ten days within which to accomplish same;
3. Defendant's Motion for Rehearing is granted in part
and denied in part. That certain Order which was entered by
the undersigned in the above cause on January 10, 1980, is
(hereby revoked and shall have no further force of effect in
this cause whatsoever and as to .that hearing on January 3, 1980,
upon the Defendant's Motion to Dismiss and Motion to Strike,
it is this Court's judgment as follows:
ia) That the Motion to Dismiss is denied. This

landlord has fraudulently or willfully concealed knowledge
Hof a defect in the premises from the Plaintiff tenant or that
the Defendant landlord otherwise possessed superior knowledge
~of said defect inasmuch as it has been alleged herein that
