THIS CAUSE HAVING COME BEFORE THE COURT on Motion. of the Defend-
ants-, ROSS PETER TSUFIS, BILL f'. TSUFIS and UNITED SERVICES AUTOMOBILE
ASSOCIATION, to dismiss Counts III and IV of Plaintiff's Complaint, and
upon written response and argument of counsel, it is hereby
ORDERED AND ADJUDGED as follows:
1. Counts III and IV of the Plaintiff's Complaint are hereby
dismissed without prejudice pursuant to the dictates of
Section 627.737, Florida Statutes, (see in this regard, Howard
v Newman, 363 So 2d 65 (1st DCA, 1978). )
~ 2. The foregoing makes the Defendants' Counterclaim and Third
Party Complaint moot at this point in time.
