(3) OTBER PROVISIONS. Questions of attorneys' fees and
proration, if any, and amount thereof will be determined by the court
after the verdict, if necessary. The Plaintiff shall prove his entire
damages as to personal property, and the court will prorate if a ver-
dict is rendered in .favor of the Plaintiff.
(4) EXPERT WITNESSES may be called out of turn by either
party.
(5) WITNESSES. Only those witnesses listed at the Pre-Trial
Conference and names filed with the Clerk up to five (5) days prior to
trial will be permitted to testify, except the parties themselves.
Either party may call any witness listed by any other party.
(6) PEREMPTORY CHALLENGES. Plaintiff shall have three
peremptory challenges. Each Defendant shall have three peremptory
challenges.
(7) JURY INSTRUCTIONS. Proposed jury instructions, on a
separate sheet for each charge, shall be submitted to the Court at
the beginning of the trial, with copies to attorneys. Additional jury
instructions shall be submitted no later than at the conclusion of the
testimony.
