CARTER and BERNICE LEE CARTER, his wife, Defendants. O R D E R THIS CAUSE coming on for hearing upon the request for the return of a cash bond from the Registry of the Court and it appearing that the cash bond in the amount of $500.00 was deposited with Roger Poitras, Clerk of Circuit Court, by virtue of a Court Order entered on June 12, 1978 and.said bond providing that if said injunction be dissolved or the Complaint upon which it is granted be dismissed, that the bond is void and shall be returned to the Plaintiff less statutory costs. That this cause having been dismissed for lack of prosecution on February 12, 1980 as shown by. Order recorded in O.R. Book 325, page 1976, it is upon consideration ORDERED AND ADJUDGED that Roger Poitras, Clerk or his duly authorized deputy Clerk, shall return the bond to the attorneys for the Plaintiff, being the law firm of Brennan, McAliley, Hayskar, McAliley & Deckert, P.A., less the statutory cost of $5.00, which shall be retained by the Clerk. DONE AND ORDERED in Ch rs at Fort Pierce, St. Lucie County, Florida,:this day of February, 1980.
