AMENDED DECLARATION OF COVENANTS
" AND R1~STRICTIONH
OF BAY COLONY OF STUART SUBDIVISION .
This Declaration made this ~ day of May, 1979, by
owners holding not lase than two-thirds (2/3) of the voting interest
of the membership of Bay Colony of Stuart.Property,Owner's Association,
Inc., a Florida corporation not for profit.
W I T N E S S E T H s
WHEREAS, BAY COLONY OF STUART, INC., th® developer, has sold
all of its interest in Bay Colony of Stuart Subdivisions and
WHEREAS, the owners of lots in said $ubdivision have taken
over control of Bay Colony of Stuart Property Owner's Association,
Inc., a not for profit Florida corporation, hereinafter referred to
as the "Association"; and
WHEREAS, a previous Declaration of Covenants and Restrictions
applicable to Bay Colony of Stuart Subdivision has been recorded
in Official Record Book 450 at Page 859 of the Public Records of
Martin County, Florida and in Official Record Book 293 at Page 484
of the Public Records of St. Lucie County, Florida; and
WHEREAS a first amendment to the aforementioned previously
recorded Declaration of Covenants and Restrictions has been recorded
in Official Record Book 450 at Paqe 2273 of the Public Records of
Martin County, Florida and Official Record Book 293 at Page 2277 of

the Public Records of St. Lucie County, Florida; and
WHEREAS, the undersigned owners who hold not less than two-
thirds (2/3) of the voting interest of the membership of the Associ-
ation wish to amend the aforementioned Declaration of Covenants and
Restrictions.
NOW, THEREFORE, in consideration of the premises, the under-
signed owners declare that lots in Bay Colony of Stuart and Bay
Colony of Stuart, First Addition, are and shall be held, transferred,
conveyed and occupied subject to the covenants, restrictions, ease-
' manta, charges and"liens (sometimes hereinafter referred to as
"Covenants and Restrictions") hereinafter set forth. This amended
