1. PROPERTY SOBJECT TO TBIS DECLARATION.
Section 1. Lec„Zal Description. The real property which is
and shall be held, transferred, sold, conveyed and occupied subject
to this Declaration is located in Martin and St. Lucie Counties,
Florida and is legally described as follows:
All land situate within Bay Colony of Stuart Subdivision
as per plats thereof on file in Plat Book 7 at Paqe 56 of
the Public Records of Martin County, Florida and Plat
Book 19 at Page~:l,of the Public Records of St. Lucie
County, Florida and within Bay Colony of Stuart,.First
Addition, as per plat thereof on file 3.n Plat Book 19 at
page 7, Public Records of 3t. Lucie County, Florida.
The above property is sometimes hereinafter referred to as the
"subdivision".
2. PROPERTY RIGHTS.
Section 1. Common Areas. The common areas in the subdivision
shall be the streets, roads and gatehouse. Said common areas are
owned by the Association as evidenced by that certain warranty deed
given by Bay Colony of Stuart, Inc. to the Association dated
February 28, 1979 and recorded in Official Record Book 465 at Paqe
' 917 of the Public Records of Martin County, Florida and Official

Record Book at Paqe Public Records of St. Lucie County,
Florida.

Section 2. Owners' Easements of Enjoyment. Every-owner shall
have a right and easement of enjoyment in and to the common areas
which shall be appurtenant to and shall pass with the title to every
lot, subject to the following:
A. Rules and regulations governing use and enjoyment of
the common areas adopted by the Association.
B. Restrictions contained on any and all plats of the
subdivision.
3. MEMBERSHIP AND VOTING RIGHTS IN THE ASSOCIATION.
Section 1. Membership. Every person or entity who is a record
fee simple owner of a lot shall be a member of the Association,
provided that any such person or entity who holds such interest only
