THIS cause came on to be heard upon the Defendant's Motion
to Dismiss and Motion to Compel Arbitration, and the Court being
fully advised in the premises, accordingly it is
ORDERED AND ADJUDGED as follows:
1. The Defendant's Motion to Dismiss is denied because the
Complaint states a cause of action for breach of contract.
2. The Lotion to Compel Arbitration is granted.
3. This case is continued until such time as the arbi-
tration proceeding is terminated at which time the Court will make
a determination as to the damages sustained by the Plaintiff and
the attorney's fees incurred by the Plaintiff, if any, as a result
of the Defendant's breach of the contract if the breach is shown,
4. The Clerk of the Circuit Court shall not dismiss this
case for lack of prosecution without personal notice to both the
attorneys for the Plaintiff and the attorneys for the Defendants.
