gate sum named in the promissory note o/ even date herewith, hereinafter described, the mortgagor here-
' 6y grants, bargains, sells, aliens, remises, conveys and confirms unto the mortgagee all the certain land
of which the mortgagor is now seized and in possession situate in St . Lucie County,
Florida. viz
The North 16.66 feet of lot 32 and all of lot 33 and the
South 16.66. feet of lot 34, Block 46, SAN LUCIE PLAZA
SUBDIVISION, Unit ~1, as per plat thereof on file in
.Plat Book 5, page 57 of the public records of St. Lucie
County, Florida.; also known as builders' lot 9,
3116 Navajo Avenue.
The mortgagor covenants and agrees to comply with all the terms
and conditions of that certain first mortgage on the above des- I
cribed property executed by Benchmark Construction Company,
Inc., in favor of First Federal Savings and Loan Association
of Fort Pierce dated May 28, 1975, and recorded in OR Book
239, page 2938 of the public records of St. Lucie County,
Florida, in the original principal sum of $24,000.00 and
mortgagor covenants and agrees that he will not permit or
suffer any default in respect to any of said covenants and
conditions of said first mortgage, and any default, breach
or violation of any terms or conditions of said first mortgage
shall be a default under the terms of this-mortgage, then and
i in that event, the principal sum hereunder secured shall be
j due and payable immediately thereafter notwithstanding
anything herein to the contrary.
And the mortgagor hereby further covenants and agrees-not to
convey the property mortgaged herein without the consent of -the I
' mortgagee, and the assumption of the new owner of the unpaid ~
balance of the mortgage, in the .event transfer of conveyance _
f is made without the consent and the assumption in due form,
the unpaid balance of this mortgage ma be accelerated
~ without notice by the mortgagee, and the mortgagee may declare
the entire debt due and payable.
