A G R E E M E N T
THIS AGREEMENT entered into by DANIEL B. KINSER, the maker of
this obligation, and JAMES C. KINSER and ELTA M. KINSER, his wife,
the holders of this obligation,
DANIEL B. KINSER acknowledges receipt of Twenty thousand dollars
($20,000.00) from_JAMES C. KINSER and ELTA M. KINSER, his wife, which
-sum was paid approximately three years previous.
DANIEL B. KINSER promises to pay, without defalcation, to the

~ order of JAMES C. KINSER and ELTA M. KINSER, his wife at 107 S. 18th
I'~~ Street, Fort Pierce, Florida, the sum of twenty thousand dollars
($20,000.00) with interest from date at the rate of nine per cent
(9~) per annum, in monthly installments as follows, One hundred
eighty dollars ($180.00) on the Fifth day of December, 1979, and a
like sum on the corresponding day of each like succeeding period
thereafter until thz whole be fully paid, subject to however, that

_ : Each installment payment first shall be applied in payment of the

default is made in the payment of any instalment when due, then at the
option of the holder, and without any other notice, all the remaining
instalments shall be due and payable at once. Privilege is given to
pay two or more instalments at any instalment maturity date,-but
this shall not extend the time of maturity~~f any subsequent instalment.
Neither forbearance, nor acceptance by the holder hereof after any
default in any payment hereon, shall be deemed extension.
Each maker, surety and endorser hereof, jointly and severally,
waives demand, presentment, protest and notice of protest for non- i

payment, and further agrees to any extension of time of payment,
either before or after maturity, without notice to any of us; and to
