HomeMy WebLinkAbout1837 • ~ C-6~4A cr RECEIPT, AC1Q~fOWLED(~Tf, ASSI~~'I'ION AND AO(:EPTANCE OF PURCHASER ' ~ • Purchaser, by acceptance and execution of this Receipt, aclmowledges that ' this purchase of a condominium unit at OCEAN VILLAGE OF HU'TCHINSON ISLAM) is subject in every respect to the Declaration of Condomminium as to the condominium in which his unit is located and Exhibits attached thereto, including but not limited to (whether the same are attached to the Declaration or referred to therein) , the • By-Laws of .the Association, Articles of Incorporation, the Rules and Regulations, copy of projected operating budget, copy of sales brochure and floor plan of apartment purchased by purchaser, and all Amendments to the aforesaid Declaration and Exhibits and the Articles of Incorporation, By-Laws and Declaration of Covenants and Restrictions of the Property Owners' Association; and Purchaser further aclaiow- ledges receipt of and reading and examination of said Declaration, its Exhibits, and budget, sales brochure and floor plan, and aclanowledges that each and every provision of the foregoing is essential to the successful operation and management - of the Condominium property and is in the best interests end for the benefit. of all.i the owners therein. Purchaser and all owners of parcels in the aforedescribed ~ Condominium covenant and agree to abide-by each and every provision of said Declara- tion of Condomin~.um and Exhibits attached thereto.. Purchaser hereby ratifies and confirms and approves all of the terms and provisions of said Declaration of Condo- minium and Exhibits attached thereto, and agrees that the assessment under the Property Owners' Association documents refetred to above and the provisions thereof are reasonable, fair and equitable, and said Purchaser aclrnowledges and confirms that the Declaration of Covenants and Restrictions of the Property Owners' Association has encumbered and impressed a lien upon the Condominium parcel being conveyed to Purchaser, as security for his obligations under the said Declaration of Covenants and Restrictions of the Property Owners' Association and said Purchaser assuQaes the obligations as to the Property Owners' Association as to his condominium parcel. f Purchaser confirms that all warranties, representations and inducements, if any, are as contained in the aforesaid Declaration of Condominium and Exhibits attached thereto, and the common expenses and the sums due under the 'Property Owners' Association and other charges are estimated only. No warranty or guaranty is made or intended nor may one be relied upon except where the same is specifically warranted or guaranteed in said Declaration of Condominium and the Exhibits attached thereto.
