for rent, gas, electricity, or other illumination, and for all
water used on said premises.
9. The Lessors, or any of their agents, shall R
have the right to enter said premises upon reasonable notice
to tenant to examine the same to make such repairs, additions
or alterations as may be dean?ed necessary for the safety, ~
comfort, or preservation thereof, or of said building, or to
exhibit said premises, and to put or keep upon the doors or
windows thereof a notice "For. Rent" at any time within thirty
(30) days before the expiration of this Lease.
10. Lessee hereby accepts the premises in the
condition they are in at the beginning of this lease and
agrees to maintain said premises in the same condition, order
and repair as they are at the commencement of said term,
excepting only reasonable wear and-tear arising from the use
thereof under this agreement, and to make good to said Lessors
immediately upon demand, any damage to water apparatus, or
electric lights or any fixture, appliances or appurtenances of
said premises, or of the building, caused by any act or
neglect of Lessee, or of any person or persons in the employ
or under the control of the Lessee. Lessors represent_ that
all electrical and plumbing facilities on the subject premises
shall be in good repair and in good working order as of the
date of conunencement of this Lease. Lessee shall be responsible
during the term of this Lease and any extension thereof, for
repairs to the demised premises not exceeding $50.00 per repair.
Lessors shall be responsible for all repairs in excess of $50.00 ,
per repair item.
11. In the event the demised premises or any
portion thereof are the. subject matter of a contract for sale,
Lessee shall be given the right of first refusal to match the
proposed contract offer within ten (10) days of notification of
sarne by Lessors.
12. Lessee agrees to maintain, during the course of
this Lease, liability insurance coverage in an amount of not
less than S30U,000.00, said policy of insurance to name Lessors
as a loss-payee thereunder.
-13. Lessors agree not to engage in either a retail
p or a wholesale grocery business for a period of five (5) years
f from date hereof in any of the following Counties:
St. Lucie, Iridian•River, Palm Beach, Okeechobee
14. Lessors acknowledge that Chey-are the owners of
property adjacent to the demised premises. Lessors hereby
covenant and agree that future development of any of the adjacent -
property will not restrict or inhibit the ability of Lessee to
back a tractor-trailer rig up to the receiving door of the
derr:ised premises.
15. Commencement of this Lease is expressly contin-
yent upon the abi~ity of the Lessee to obtain all licenses and
permits required for Lessee to open and operate a retail and }
~ wholesale cash and carry grocery-and beverage store or distribu-
tion center.
16. It is expressly understood that Lessors shall
not be liah~c~ for casualty loss due to an act of God, nature or
any anima? on or about. the demised premises.
