HomeMy WebLinkAbout2328 17. Lessee understands and agrees that no load bearing walls or posts may be removed or altered without the express consent of the Landlord. 18. The parties Hereto acknowledge that Lessee c~ill be making modifications to the existing electrical and plumbing facilities. It is understood and agreed that all such modifications shall be at Lessee's expense and all such modifications shall comply with existing Building Codes and standards. 19. In connection with the execution and commencement of this Lease, it is understood and agreed by and between the parties hereto that Lessee shall purchase from Lessor inventory on the premises as of March 2, 1980. Payment for said inventory shall be based upon invoices for said purchases in cash at such time as the inventory is computed and extended. 20. As a further consideration under the terms of this Lease, Lessee does hereby agree to purchase from Lessors the following equip- ment at the prices indicated: Beer Cooler $ 800.00 5 Sets of Rollers 150.00 2 Hand Grocery Dollies 45.'00 Stainless Steei Table 65.00 Meat Grinder 310.00 Heat Sealer 105.00 Electric Saw 495.00 Meat Hand Saw 8.00 Three-Tub Stainless Steel Sink 425.00 High-Rate Hot t•:ater Heater 400.00 12 X 16 Walk-In Cooler, complete 6,510.00 Computer Scale 875.00 Time Clock 100.00 . Butcher Paper Dispensers (3) 15.00 8' metal sign with letters 800.00 11,09 3.00 It is understood and agreed that ?.0$ of the purchase price ($2,218.60) shall be paid Lessors on March 2, 1980. The balance of the purchase price ($8,874.40) shall be paid in sixty (6A).equal monthly installments of $147.91 per month. Lessee does hereby agree to secure Lessors with a Promissory Note, Chattel Mortgage, and UCC Financing Statements on the items noted above. Lessors represent that all of the items noted above shall be in good working order as of b±arch 2, 1980, and that same shall be free and clear of any liens or encumbrances. 21. Lessors do hereby grant to Lessee the op*_ion to renew this Lease for three, five-year terms. Exercise of this option to renew must be given to Lessors in writing not less than six (6) months . prior to the end of the existing five year period. Rent paid on any renewal option shall reflect a cost of living increase using as a basis the cost of living as of March 2, 1984. The option terms shall be upon the same terms and conditions as contained in this Lease Agreement. 22. If the Lessee s all become insolvent or if bankruptcy proceedings shall be begun by or against the Lessee, before the end of said term the Lessors are hereby irrevocably authorized at their k option, to forthwith cancel this Lease, as for a default. Lessors . may elect to accept rent from such receiver, trustee, or other judicial officer during the term of their occupancy in their fiduciary capacity without effecting Lessor's rights as contained in this con- tract, but no receiver, trustee or other judicial officer shall ever have any right, title or 'interest in or to the above-described property by virtue of this contract. -Page Four- BO(K~ .
