AFFIDAVIT
STATE OF FLORIDA
COUNTY OF MARTIN "
Before me, the undersigned authority in and for the
State of Florida at Large, personally came and appeared MILDRED W.
DUDDINGTON, who, after being duly cautioned and sworn, deposes and
says:" .
1. That Affiant is one and the same person as Mildred
I. Williams, also known as Mildred Williams, whose name appears as
a grantee on that certain Quit Claim Deed executed by William D.
Dudding on or about April 5, 1973, which said Deed was recorded in .
Official Records Book 212, Page 2353, St. Lucie County, Florida,
public records. -
2. That Affiant and her sister, Doris J. Allen, are
the-sole surviving Trustees of that certain Inter Vivos Trust created
by William D. Dudding, of Hennepin County, Minnesota, as Settlor,
on the 28th day of August, 1972.
3. That the said William D. Dudding departed this
life on or about July 3, 1979 in St. Augustine, Florida.
4. ?hat the said William D. Dudding never at any time
during his lifetime amended or revoked said instrument of trust;
and that the said William D. Dudding appointed Doris J. Allen as an
additional Trustee under the aforesaid Inter Vivos Trust on or
about the 12th day of March, 1973.
5. That no other Trustees have been appointed pursuant
to the terms of Article V. F of said Trust; and that Affiant and
the said Doris J. Allen have not exercised their full and uncontrolled
discretion of termination pursuant to Article V. G of said Trust.
