THIS CAUSE coming on for hearing this 4th day of March,
1980, upon the Motion to Dismiss filed by the Defendant, ~
SOUTHERN U.S. LAND DEVELOPMENT CORP., and the Court having
heard argument of counsel and being otherwise fully advised
{
in the premises, it is upon consideration
ORDERED AND ADJUDGED as follows:
(1) That the Motion to Dismiss filed by the Defendant,
SOUTHERN U.S. LAND DEVELOPMENT CORE , be and the same-is
hereby denied.
• (2) That the Defendant, SOUTHERN U.S. LAND DEVELOPMENT
CORP., shall have twenty (20) days from the date of this Order
to file an answer to the Amended Complaint. .
(3) That the Plaintiff be and it is hereby granted the
right to amend by interlineation in the Amended Complaint,
Count I, paragraph (7) by adding the following sentence at
the end of said paragraph:
"There is no justiciable ,issue and under
Florida Statute 57.105, attorney's fees
are due."
