After due notice by on to all parties affected, on
March 4, 1980, a hearing was held before the Court with respect
to the matters disposed of by this Order. Upon consideration,
it is,
ORDERED AND ADJUDGED that the Motion to Dismiss Counts I
and II of the Complaint previously filed herein by the Plaintiff
is granted; the Plaintiff, VIRGIL M. VICKERS, shall have
fifteen (15) days in which to file an Amended Complaint.
