DECLARATION OF COVENANTS AND RESTRICT10tIS
- TARPOP7 BAY YACHT CLUB
S.C.S. TARPON BAY, INC. and HASCO TARPON BAY, INC., both
Florida corporations, a joint venture D/B/A TARPON BAS', its
successors and assigns ("Developer"), owner and developer of that
certain real property known as TARPON BAY YACEIT CLUB, as more
particularly described in Exhibit "A" attached Hereto, hereby
declares-that the real property described in Exhibit "A" is and
shall be held, transferred, sold, conveyed and occupied subject to
those covenants, restrictions, easements, charges and liens
hereinafter set forth in this Declaration of Covenants and
Restrictions, hereinafter referred to as the "Declaration". .
SECTION I. PROPERTY SUBJECT TO THIS DECLARATION7.
The property subject to this Declaration i_s that real
property (the "Property" or'"Tarpon Bay Yacht Club"), located in
St. Lucie County, Florida, particularly described in Exhibit "A"
attached hereto and incorporated herein by reference.

i At or about the time of the filing of this Declaration, the
Developer has caused to 5e formed TARPON. BAY YACHT CLUB PROPERTY

Florida corn~rat-ion not for profi-t, by the filing of the Articles
of Incorporation therefor in the office of the Secretary of State
of Florida. The p~.~rposes and powers of the Association shall be S
all of the purposes and powers set forth in this Declaration and
in its Articles of Incorporation and By-Laws. The Association
shall provide an enti-ty for the execution, performance, -
administration ar.d enforcement of all the terms and conditions of
