- _ members. Property acquired by the Association other than the
Common Property shall be known as "Association Property".
3. maintenance of Property. The Association is
authorized to and shall, either by virtue of the appointment of a
real estate management agent, or through its own personnel,
provide for the maintenance and repair of the Common Property and
the Association Property. Developer, its affiliates, successors
and/or assigns, may be the management agent and nothing shall be
deemed to invalidate any agreement between -the Association and the -
Developer or its affiliates for` the reason that at the time of
entering into the agreement, employees, officers or agents of the
Developer or its affiliates are the officers and/or directors of
the Association. -
4. Rules and Regulations Governing Use of Common
Property. The Association, through its Board of Directors, shall
regulate the use of the Common Property by its members and may
from time to time promulgate such rules and regulations consistent
with this Declaration governing the use thereof as it may deem to
be in the best interest of its members. A copy of all rules and
regulations established hereunder and any amendments thereto shall
be provided to all members of the Association. These rules and
regulations may be enforced by legal or equitable action. Part of
the Common Property is a marina containing boat slips and docks.
The Association, through its Board of Directors, shall regulate
the use of the marina. and shall pro:r=ulgate a Declaration of Use of
Boat Slips and Docks which establishes rules and regulations for
the boat slips and docks consistent with this Declaration.
C. Enforcement of Restrictions. The Association, through
its Board of Directors and Officers, shall have the authority tv
-enforce restrictions imposed by this Declaration.
D. Assessments. The Association, through. its Board of
Directors, shall have the power and authority *_o make and collect -
assessments as hereinafter set forth.
