- and shall be open to inspection by any member. The Association
shall, upon demand, furnish a member liable for assessments, a
certificate in writing signed by an officer of the Association,
setting forth whether the member's assessments have been paid
and/or the amount which is due as of any date. As to parties
without knowledye of error, who rely thereon, such certificates
shall be conclusive evidence of payment or partial payment of any
assessment therein stated having been paid or partially paid.
SECTION III. MAINTENANCE OF COMMON PROPERTY.
The Association shall be responsible for maintenance of the
Common Property, including but not limited to, the following;
A. Parking areas;
B. Roadways and H'alkways;
C. Pool and Sundeck;
D. Clubhouse and Pavillions;
E. Entrance Island and Guardhouse;
F. Tennis Courts;
G. Marina.
H. Surface water management system as permitted by South
Florida Water Management District.
The maintenance obligations of the Association, as set forth
in this Section, shall be the obligation solely of the
Association. The members shall have no individual right to
repair, alter, add to, replace, paint or in any other way maintain
the Common Property.
Notwithstanding anything contained in this Section, the
expense of any maintenance, repair or construction of the Common
Property necessitated solely by the negligent or willful acts of a
member or his family or guests shall be borne solely by that
member and such member's unit or parcel shall be subject to an
individual assessment for such expense.
SECTION IV. USE AND ENJOYMENT OF COtlAtON PROPERTY.
A. Members' Easements of Enjoyment. Subject to the
provisions of this Section every member of the Association shall
have a right and easement of enjoyment in and to the Common
