the construction fund are to .be upon the order of tt~e Association
or upon approval of an architect or otherwise, nor whether a
disbursement is to be made from the construction fund, nor to
determine the payee nor the amount to be paid. Instead, the
Insurance Trustee may rely upon a certificate of the Association
made by its President and Secretary as to any and all of such
matters and stating the name of the payee and the amount to be
paid.
F. Equitable Relief. In the event. of major damage to or
destruction of part of the Common Property, and in the event the
property is not repaired, reconstructed or rebuilt within a
_ reasonable period of time, any member shall have the right to •
petition a court of equity, having jurisdiction in and for
St. Lucie County, Florida, for equitable relief. -
SECTION VII. GENCRAL PROVISIOi7S.
A. Duration and Remedies for Violation. The covenants and
restrictions of this Declaration shall run with and bind the
Property and shall inure to the benefit of and be enforceable by
the Developer,'the Association or the owner of any unit or parcel
subject to this Declaration and their respective legal representa-
j tives, heirs, successors and assigns, for an initial term of fifty

(SO) years from the date this Declaration is recorded. The
covenants and restrictions shall automatically be extended for

~ successive periods vi ten (iu) years unless an instrument signed
by the then owners of two-thirds (2/3) of the units or parcels as
have then been subjected to this Declaration has been recorded,
agreeing to change or terr.:inate the covenants and restrictions in
whole or in part. Violation or breach of any condition, covenan t
or restriction herein contained shall give the Developer and/or
4 the Association a right of action before any court of competent
jurisdiction, whether in law or in equity, to compel compliance
with the terms of the covenants or restrictions, and to prevent
the violation or breach of any of them, and the expense of such
