condominium property consists of the Land, all e~zseu~ents and
rights appurtenant thereto, and the building constructed thereon,
comprising in total the units, common elements and limited common
elements. The improvement on the [,and consists of orie three (3)
story building in whictr all the units are located. The condo-
minium has eighteen (18) units. Each floor of tine building has
six (6) units..
3.1 t)esiynation of Units. Lath unit is designated
try a three (3) digit designation. `tire first two digits in the
designation indicate the floor on which the unit is located, in
ascending order, as follows: 10 = first Eloor; 2-U~= second floor;
30 tl~ ird floor . The third digit indicates tt~e location of tl~e
unit on the floor, comrnenciny with "1"; and running left to right,
facing the main entrance of ttie building. Tt~e identification,
type and location of each unit can be established tro~~ i.xhibit "I3"
attached hereto anti incorporated herein by reference. too unit
bears the same designation as arty ottrer unit.
3.2 Unit Boundaries.
(a) Each unit shall have as its boundary lines the
interior unpainted finished surfaces of ttie ceiling, floor,
and perimeter walls. All weight bearing walls and solid
concrete column located within a unit corisitute part of tt~e
common elements up to the unpainted finished .surface of the
walls and columns. All doors, c3lass or otherwise, ant]
screening which are part of or in the perimeter walls of a
unit shall be deemed a part of the unit up to the exterior
unfinished surface thereof.
(b) 1111 pipes, wires, conduits and other utility
lines, regardless of location, constitute part of the common
elements, up to their outlets.
(c) `1'he screened terrace in each unit is a part of
that unit. 'Itre boundary lines of each terrace are the
interior vertical and horizontal surfaces thereof, and the
exterior unpainted finished surface o£ the perimeter
baluster, screening, or wall abutting the terrace, but the -
Association, and not the unit owners, shall maintain grad
repair tiie exterior walls of_ all terraces. `itie planes of all
boundaries shall be ex tended. to the point of intersection
with other boundaries, if necessary. .
(c3) 'I1~e ventilation chases and plumbing chases
located within a unit are common elements. The t~oundary
lines of each chase shall be the exterior unpainted surfaces
thereof.
3.3 Conunon Property. The gatehouse, roadways, park-
. m y areas, walkways, clubhouse, tennis courts, l~avillion, swimming
pool and sundeck area, anti other amenities serving this Condo-
miniurn as well as the balance o£ Tarpon Bay Yacht Club are located
on the Common Property. The unit owners in this Condominium will
share use of the Co,nmon Property with a maximum of one hundred '
fifty (150) other dwelliny_ units which may be constructed on the
balance of 't'arpon 13ay Yacht Club. 'lire Property Owners Association
is responsible for the manaclement, maintenance and operation of
the Common Property. t~ clarant will convey title to the Common
Property to the Proi~erty Uwners Associ~~tion Cor no additional
consideration no later than the date of closing on the sale
