' ~r aS .4'79369 AMENDMENT TO DECLARATION OF CONDOPIINIUAI OF t1IGt1 POINT OF FORT PIERCE CONDOMINIUt•1 SECTION II TO ADD PHASE XVI THIS AMENDMENT (the "Amendment") to the Declaration of Condo- minium of High Point of Fort Pierce Condominium Section II to add Phase XVI is made this 15th day of February 1960 by HIGH POINT EQUITIES, INC., a Florida corporation (the "Developer"). WHEREAS, pursuant to the Condominium Act, Chapter 718, Florida Statutes, 1976 (the "Act"), Developer has established High Point of Fort Pierce Condominium Section II (the "Condominium") according to the Declaration of Condominium (the "Declaration") thereof recorded in Official Records Book 304, Page 1396 of the Public Records of St. Lucie County, Florida; and WHEREAS, the Condominium is a "Phase Condominium" as contemplated by Section 718.403 of the Act as stated in Article I of the Decla- ration; and WHEREAS, the Declaration provides for additional "Phases" (as described and defined in the Declaration) to be added to the Condominium; and WHEREAS, Developer desires to add Phase XVI to the Condominium as a part thereof, SOW, THEREFORE, Developer as the owner in fee simple of the "Phase Y\'I Land" (as defined in the Declaration and described on Exhibit P thereto and Exhibit A hereto) and-all of the improvements shown on the Survey, Plot Plan and Graphic Description of Improve- ments Phase XVI High Point of Fort Pierce Condominium Section II attached hereto as Exhibit B and made a Hart hereof (the "Attached Survey") hereby states and declares that Phase XVI as described in the Declaration and as shown by the Attached Survey is hereby submitted to condominium ownership and added as a part of the Condominium. It is recognized that the description of the proposed improve- ments for Phase XVI as set forth in Article V.C.15. of the Decla- ration contemplates that this Phase XVI shall contain Buildings 125,. 127, 131 and 1202 as well as the parking facilities shown on Exhibit P-1 to the Declaration (hereinafter "Exhibit P-1"). However, the said Exhibit P-1 reflected Buildings 125, 127, 129 and 1202 as well as various parking spaces containing, respectively, as part of their designation the number of said Buildings. All designations of the number "129" on said Exhibit P-1 (that is, Building 129 and parking spaces 129x'1, 129B, 129C and 129D) were so designated through scrivener's error and such designation of "129" should have instead been "131" all as shown on the Attached Surve}~. This Amendment shall also serve to correct that scrivener's error and in this connection High Point of Fort Pierce Condominium Section II Association, Inc. has joined in the execution hereof. This Amendment shall become effective upon recording same amongst the Public Records of St. Lucie County, Florida.
