Motion to Dismiss/Alternative Motion to Strike, and the Court
being fully advised in the premises, it is hereby
ORDERED AND ADJUDGED that as to Counts I, II and III,
the Motion to Dismiss is denied and as to Count IV the Motion
to Dismiss is granted and Plaintiff shall have fifteen (15)
days to amend said Count IV. ~
IT IS FURTHER ORDERED AND ADJUDGED that the Alternative
Motion to Strike is rendered moot.
FURTHER the Plaintiff has voluntarily deleted by inter-
