O R D E R
THIS CAUSE coming on for hearing on March 5, 1980 on
Defendants' motion for judgment on the pleadings, and the
Court having considered argument of counsel and memoranda of
law, finds and determines:
Paragraph 10 of the complaint alleges that the
Defendants, in bad faith, failed and refused to build the
condominium because the Defendants determined that it would be
unprofitable to commence construction of the buildings. All,
well pleaded allegations of the non moving party on a motion
for judgment on pleadings are taken to be true, while those
of the movant that have been denied are taken as not proved
in determining the motion. Upon consideration, said motion
for judgment on the pleadings is denied.
