Dismiss or Abate the Petition and Amended Petition filed in the
Estate of Perry Carlton, deceased, be, and is hereby ordered denied.

4. The Motion of the Defendant, CARL CARLTON, SR., to ~
consolidate the actions on the Petition and Amended Petition
filed in the Estate of Perry Carlton, deceased, File No. 70-75, into
and with the action styled First National Bank of Fort Pierce,
Administrator of the Estate of Perry Carlton, deceased, Plaintiff,
-vs- Carl Carlton, Sr., Defendant, Case No. 78-497 CA, be, and
is hereby ordered granted and the actions filed in the Estate of
Perry Carlton are consolidated with the case of the First National
Bank of Fort Pierce, Administrator of the Estate of Perry Carlton,
deceased, Plaintiff, -vs- Carl Carlton, Sr., Defendant, Case No.
'78-497 CA, and all of the pleadings, motions, notices, discovery '
and other items filed in this consolidated cause shall be filed
in Case No. 78-497 CA and shall not be required to also be filed
in Case No. 70-75 CP. It, be, and is hereby further ordered that
neither the Plaintiff nor Defendant shall be required to give
notice of the filing of any item of record or of any hearing or
of any matter normally requiring notice to any person or entity ~
not a party to Case No. 78-497.
