1. The motion of the FIRST NATIONAL BANK OF FORT PIERCE,
Administrator of the Estate of PERRY CARLTON, to dismiss the Counter-
claim of CARL CARLTON, SR., be, and is hereby ordered granted and the
Counterclaim of CARL CARLTON, SR., be, and is hereby ordered dismissed
and the Defendant, CARL CARLTON, SR., is granted twenty (20) days to
file an Amended Counterclaim.
2. The provisions of the prior Order of this Court conso-
lidating the cases of the FIRST NATIONAL BANK OF FORT PIERCE, Admin-
istrator of the Estate of PERRY CARLTON, Deceased, Plaintiff -VS-
CARL CARLTON, SR., Defendant, Case No. 78-497 CA together with the
case of IN RE: Estate of PERRY CARLTON, Deceased, File No. 70-75 CP,
be, and are hereby ordered vacated and the proceedings on the subject
matter of monies alleged to be owed to said Estate by CARL CARLTON,
SR., as set forth in the Petition and Amended Petition which are
both now pending in IN RE: Estate of PERRY CARLTON, Deceased, File
No. 70-75 CP, be, and are hereby ordered stayed pending the outcome
of the proceedings in said Case No. 78-497 CA and the subject matter
of the action in Case No. 78-497 CA, be, and is hereby ordered severed
from the case of IN RE: Estate of PERRY CARLTON, Deceased, File No.
70-75 CP.
3. This Court expressly retains jurisdiction of this cause
to enter such orders as it deems necessary and .proper in File No.
70-75 CP upon the conclusion of the proceedings in Case No. 78-497 CA.
