by Pdorman L. Paxton, Jr., Esquire, and the Defendant having been repre-
sented by John Edgar Sherrard, Esquire, and the Court having heard argu-
ment of counsel and being furnished briefs herein, and being otherwise.
fully advised in the premises, it is therefore
ORDERED AND ADJUDGED that the Defendant's Amended Counter-
claim be and the same is hereby dismissed. (See Prosser on Torts, 4th
Ed. pp. 356.)
