or a communist or totalitarian political takeover.- Accordingly,
it is the Settlors' intention to give the Trustee extraordinary ~
`I discretionary powers should any such eventuality supervene. ~

~ If then (a) through a state of war, civil disorder, radical

! political change, or thQ like, it shall become impossible ,
for the Trustee to determine whether both of the Settlors

are either dead or alive after a period of three (3) months,
and (b) if further the Settlors' son or issue shall make

contact with the Trustee from anon-communist land and
require financial assistance, then the Trust is hereby
-
authorized to utilize so much of the income and/or principal
-
of the Trust as it shall deem necessary in its absolute ~
discretion for the health, education, support and maintenance
i of the Settlors' said son and/or his issue. It is the
- intention of the Settlors to include. within the term "main- ,
ij
tenance" as regards to such issue, the maintenance of their
natural guardian during their minority. If, after a period

of five (5) years the Trustee shall still be unable to
' determine whether tha Settlors are either dead or alive,
they shall be conclusively deemed to have died, and all

assets of the Trust after payment of all Trust expenses and
applicable taxes, shall forthwith be distributed to the

;;•Settlors' said son, if living, or if not, then to his issue,

per stirpes, free from trust. In the same manner, if the '

! E~ Settlors' said son and/or hie issue cannot be determined to - i

~ i! be either dead or alive (for a period of five (5) years as

to the son, and ten (10) years as to his issue) then they
respectively shall be conclusively deemed to have perished.

Retain Investments of Settlors i
4.01. The Trustee is authorized to retain in the
trust for such time as it may deem advisable any property, ,

received by it from the Settlors, whether or not such property
