THIS CAUSE came on to be heard on March 1.0, 1980,
upon the Defendants' Motions to Dismiss and Motion to Strike.
Defendant, NORA MILLER, was represented by counsel and Defen-
dant RICHARD MILLER appeared on his own behalf and on behalf
of POINTE SOUTH BUILDERS, INC. The Court having considered
the pleadings and arguments of counsel and of RICHARD MILLER,
it is
ORDERED AND ADJUDGED as follows:
1. The Motions to Dismiss be and the same are here-
by granted in part as follows:
2. Count I is dismissed as to NORA MILLER and
RICHARD MILLER only.
3. The motions as to Count II are denied.
4. Count III is dismissed.
5. The Motions to Strike are neither reached nor
ruled upon in light of the foregoing actions.
• 6. Plaintiff shall have .twenty (20) days from the
date of this Order within which to file an Amended Complaint.
7. Defendants shall have twenty (20) days from the
date they are served within which to respond to the Amended
Complaint.
