or waive any default by Mortgagor hereunder or_under the
Note or any other Related Document. Mortgagor agrees that ?
in determining whether or not any interest payable under the
Note or this Mortgage or the other Related Documents exceeds
the highest rate permitted by law, any non-principal payment
(except payments specifically stated in the Note to be
"interest") including, but without limitation, prepayment
fees and late charges, shall be deemed to the extent permit-
ted by law to be an expense,~fee, premium or penalty, rather
than as interest. ~
32.- Mortgagee's Right to Publicize Source of
Financin Mortgagee shall have the right to announce and
pub icize the source of financing for the Mortgaged Property,_
and to select the media, means and frequency of the gubli city]
including, without limitation, advertisements and other
devices of Mortgagee's choice, and maintenance of a sign at
the Mortgaged Froperty.
33.~ S ecial Insurance and Condemnation Provi-
sions. Upon Mortgagee giving its written consent to t e
re`cor~ation of a Declaration ~of Condominium for the Mort-
gaged Property and upon Mortgagor's due execution and
recording of the approved Declaration of Condominium, Mort-
gagor shall no longer be required to maintain any insurance
.under Paragraph 4 for which the Condominium Association will
maintain the same or similar insurance coverage, and the
provisions of Paragraphs 4 and 16 regarding adjustment of
losses and application of proceeds shall be superceded by
any conflicting provisions of the Declaration of Condominium,
.subject however to the provisions of Paragraph 27 of this
Mortgage; provided, however, the provisions of Paragraphs 4
and 16 shall remain in effect for any portions of the
Mortgaged Property not included in the Declaration of Con-
domi ni um .
34. Communications. All communications required
under this Mortgage or the Note or the Related Documents
shall be in writing, and shall be sent by registered mail,
postage prepaid, return receipt requested,~addressed to
Mortgagor and Mo rtgagee at the addresses set forth in the
heading of this Mortgage, or at such other address as the
addressee may designate.
35. Covenant Running with the Land. Any act or
agreement to be done or performed by Mortgagor shall be
construed as a covenant running with the land and shall be
binding upon Mortgagor and. its successors and assigns as -if
. they had personally made such agreement.
36. Amendment. This Mortgage cannot be changed
or amended except by agreement in writing signed by the
party against whom enforcement of the change is sought.
