to exercise any or all rights and privileges~of
Assignor-under any or all of the Purchase Agreements
or the Condominium Documents, or accruing therefrom;
. (c) to enforce, cancel and/or modify any or all
of the Purchase Agreements in accordance with their
terms; and
(d) to perfona such other acts in connection
with the Purchase Agreements and Condominium
Documents as the Assignee, in its discretion, may
deem proper.
4. Neither tze receipt by the Assignee of any
deposits, sums or payments, nor the exercise in whole or in
part by Assignee of any authority pursuant to this instrument,
before or after the institution of foreclosure proceedings
under the Mortgage or before or after the institution of any
proceedings under the Note or Construction Loan Agreement
shall cure-any default in-the performance of any of the terms.
and conditions of the Note, the Mortgage, or the Construction -
Loan Agreement or affect any such foreclosure or other
proceedings or any sale pursuant thereto. Assignee shall
have no liability for the payment of interest to Assignor
on any of said deposits, sums or payments.
5. In the event of any default in the performance
of any of the terms and conditions of the Note, Mortgage or
Construction Loan Agreement., Assignee may perform or -d is-
charge any obligation or duty to be performed or discharged
by Assignor under or arising from any of the Purchase Agree- ~ ~

meets or Condominium Documents, but Assignee shall not, at
any time, be obligated to do so. Assignor hereby agrees to
indemnify the Assignee for, and to save it harmless from, any
