HomeMy WebLinkAbout1173 • ~ r and all liability arising under any of the Purchase Agreements and the Condominium Documents or under or from this Assignment, unless caused by the acts of Assignee other than the exercise of its rights hereunder. Assignee's performance of any obli- i gation or duty to be performed by Assignor shall not obligate ~ Assignee to perform any other such obligation or duty. 6.' This Assignment shall not place responsibility , for the control, care, management or repair of the Property 1 or units in the Condominiums owned by Assignor upon the Assignee, or make the Assignee responsible or liable for any negligence in the management, operation, upkeep, repair or control of the Property or units in the Condominiums owned by Assignor resulting in loss or injury or death to any pur- chaser or owner of any unit in the Condominiums or any tenant, i licensee, employee or stranger. Nothing contained in this ~ instrument shall cause Assignee to be responsible to any € party for any assessment made by the Condominium Associations _ • ~ or for any violation of the Condominium Documents. 7. The Assignor covenants and represents that: (a) it has full right and authority to assign its interest in the Purchase Agreements and the Condominium Documents and to assign said deposits, sums, payments, rights and privileges subject to any limitations imposed by law; (b) the terms of the Purchase Agreements and Condominium Documents have not been and will not be changed from the terms in the copies thereof sub- mitted to and to be submitted to the Assignee without the prior written consent of Assignee; (c) no other assignment of any interest of Assignor in the Purchase Agreements or Condominiums Documents or deposits, sums or payments has been made; ~ and, cc• B(l01(c~0 PdGE ~7•~ _5_
