HomeMy WebLinkAbout1176 j ..,r ~ f i r 1 S in its name, place and stead, to execute or file of record or both. any or all documents, instruments, papers, plans, maps and surveys (including, but not limited to, the Condominium Documents) which Assignee, fn its sole opinion, may deem necessary in order to close all or any of the Purchase Agreements, which Assignee, in its sole opinion, i -may deem necessary in order to create and maintain the Condominiums laid out and constructed in ac- cordance with the Purchase Agreements (including, without limitation then-eto, documents, instruments, plans, papers, maps and surveys referred to in sub- ! paragraphs (a) (i) and (ii) hereof, whether or not they differ from those forwarded to Assignee by or on behalf of Assignor), and to do any or all ~ other things which Assignee, in its sole opinion, may deem necessary to close all or any of the Purchase Agreements; giving and granting unto said f attorney by these presents, full and complete authority to act as fully and completely as f Assignor might do if personally present and to do ~ all lawful acts requisite to effect the premises; rati fying and confirming all said attorney may do { by virtue of these presents. This Power of Attorney is coupled with an interest and is irrevocable. An affidavit made by Assignee that a default has occurred under the terms of the Note, Mortgage t and/or Construction Loan Agreement shall be sufficient proof - of any such default for the purpose of Assignee's exercise of this Power of Attorney and other rights and privileges assigned herein. -8- .
