9. Time is of the essence of this Agreement. In
the event Buyers fail to make -any payments required by the tercas
k
of this contract at the time the same falls due and prior to the
delinquency .thereof, including installment payments to the
Sellers, and if such default continues for Sixty (60) days,
Sellers at their option may:
Accelerate and bring an action for the balance of
t
the purchase price remaining due, or for any other relief ~ t
available in law or equity, including suit to recover any payment
or payments made by the Sellers and repayable to the Buyers -
hereunder, it being stipulated and agreed that such obligation to
re-pay is a separate and independent covenant of the Buyers. No
action to recover any payment or payments so made by the Sellers
shall constitute a waiver of the rights to proceed otherwise with
respect to any subsequent default.
- No waiver by the Sellers of any default of the
Buyers shall be construed as a waiver of any subsequent default.
10. The parties acknowledge that default shall be
construed as having occurred hereunder when the payment as re-
quired by the Buyers shall have been delayed or not made within
Sixty (6~)~days of the due date thereof. -
11. It is agreed that the Se1l~ers shall continue -
to be responsible for all Mortgage payments due WILLIAMSBURG

SAVINGS BANK, and to keep current in all respects those i
~ provisions as set forth in the Mortgage and Note due the said
Mort a ee. In the event Sellers shall default in the ~

of any of their obligations thereunder, Buyers shall have the
right to cure such default and to apply the full amount of any
monies so paid to the reduction of the indebtedness due the
Sellers under the terms of this Agreement.
- 12. The closing of the within transaction shall

be at the offices of HAROLD H. GOLDMAN, ESQUIRE, 8028 South :
Federal Highway, Port St. Lucie, Florida 33452, on or about
April 1, 1980, at 10:00 A.M.. At the time of the closing Sellers
shall be responsible for the: documentary stamps necessary to be

affixed to this Agreement, all real estate commissions, tax
