This cause, having come on to be heard before me
on March 10, 1980, upon Defendant's Motion to Dismiss, and _
` this Court having heard the arguments of counsel, and bein

otherwise fully advised in the premises, it is upon consideration
ORDERED AND ADJUDGED as follows: -
1. The Complaint of Plaintiff as to Counts II, IV,
V, and VI be and the same are hereby dismissed with leave for
the Plaintiffs to amend their Complaint within twenty (20)

~ days hereof.

2. Ruling upon Count I shall be withheld until the
filing of briefs by Defendant, responsive brief by Plaintiffs,
f and rebuttal brief by Defendant.
3. In all other regards the notion be and the same
is hereby denied.
