MOTION TO TRANSFER LIEN
FROM REAL PROPERTY TO OTHER SECURITY
COME-NOW the Defendants, DOUGLAS GILBERT, a/k/a A. DOUGLAS
GILBERT and MARTHA GILBERT, a/k/a MARTHA B. GILBERT, his wife,
by and through their undersigned attorneys and move this Court
in accordance with Florida Statute 713.24 and moves the Clerk
(
for a certificate showing the transfer of the lien from real
property described herein to the security deposit herewith and

show:
(1) That the Plaintiff, GERALD JOHNSON, filed a Claim of $
Lien on April 6, 1979 as recorded in O.R. Book 306 at page 1716,
in the Public Records of St. Lucie County, Florida, against the
I
following described property:
Lot 20, Block 11, SURFSIDE SUBDIVISION UNIT TWO,
according to the plat thereof as recorded in Plat
I Book 11 at-page 8 of the_Public Records of St.
Lucie County, Florida.
(2) That on May 18, 1979, the above-styled action to
foreclose said Mechanic's lien was filed along with a Notice
of Lis Pendens claiming an amount due of $3,207.00, which the
Defendants in good faith intends and is contesting.
(3) That in accordance with §713.24 of the Florida Statutes,
~ the Defendants herewith are paying into the Registry of the
Court the sum of $3,920.19 computed as follows:
. 1. Amount alleged due: $3,207.00
~ 2. Interest for 3 years: 577.26 ;
3. Cost deposit: 100.00
' 4. Clerk's fee for deposit: 21.93
5. Clerk's fee for Certificate of
Service and recording: 14.00
