property in a good and husband-like manner and in accordance
with standard methods of caretaking used in St..T,ucie County.
8. BROKERAGE: Broker's fee will be paid by Estate and
will be $5,000.00 to be paid at the date of closing.
_ 9. SURVEY: Richardson shall have the privilege of
surveying the property at his own expense by a land surveyor
registered in the State of Florida. This is a net sale and
the purchase price will not be subject to any survey.
10. CLOSING: Closing shall be on February 29, 1980, at
the law office of Brennan, McAliley, Aayskar & McAliley at
519 South Indian River Drive, Fort Pierce, Florida.
11. DEFAULT: If Estate defaults under this Agreement,
it shall reimburse Richardson for all caretaking expense by
Richardson to the date that the default occurs and Estate
goes back into possession of the premises, and the Escrow
Agent is directed to pay to Richardson the deposit made
under this Agreement in the amount of $5,000.00. If Richardson
defaults under this Agreement one-half (1/2) of the $5,000.00
deposit will be paid to the broker and the other portion .of
the deposit, along with any other moneys held in escrow,.
shall be paid over to Estate. In the event of a default by
either party, the defaulting party will be responsible to
pay a reasonable attorney's fee to the non-defaulting party
incurred in enforcing the terms of this Agreement.
12. COSTS: Costs and charges incident to this transaction
will be paid as follows: .
