This cause came on for hearing on the Motion to Tax

Costs and Assess Attorneys Fees filed by the Defendant,
JOSEPH NOELKE, Owner of Parcel 121 and counsel for Plaintiff
having voiced no objection to any of the cost items set
forth in said motion, and the Court having considered evi-
dence offered by both parties as to attorney's fees and the
Court having considered argument by counsel, it iS thereupon

ORDERED AND ADJUDGED as follows:

i{ 1. Costs in the amount of $1,980.92 are hereby assessed

in favor of the Defendant and against the Plaintiff.

2. Attorneys fees in the amount of $6,000.00 are
hereby assessed in favor of the Defendant and against the
Plaintiff .
It is further -
ORDERED AND ADJUDGED that Plaintiff DIVISION OF ADMIN-
ISTRATION, STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION1
shall forthwith deposit in the registry of this court the
sum of $7,980.92 and the Clerk, without further order of
