This cause coming on to be heard this 31st day of March, 1984
upon several Motions filed by the parties, and the same having

been argued by counsel, and the Court being advised in the premise
it is thereupon ~
ORDERED AND ADJUDGED:
1. That the Plaintiff, FLORIDA EAST COAST RAILWAY COMPANY'S,
Motion to Strike paragraph 5 (h) of the Counterclaimants' Counter-
. claim be and the same is hereby granted. Counterclaimants are giv
fifteen.(15) days to amend their Counterclaim in its entirety.
2. Plaintiff's Motion to Strike punitive damages from ~
Defendants Ames' Counterclaim is hereby granted without prejudice ~
to the Counterclaimants reasserting such claim to conform to the
evidence.
j 3. Counterclaimants Ames' Motion for Continuance is granted,
i
E and trial of this cause is hereby striken from the trial docket of
Apirl 14, 1980.
4. This cause is hereby consolidated with the suit of
Harry B. Koenig vs. Florida East Coast Railroad Company, Case No.
80-131 CA pending in this Court for trial and other purposes.
5. The Counterclaimants' Motion for Severance is hereby t
