GILBERT, Motion for Sumtnary Judgment and the Court having heard argument
of counsel and being otherwise fully and well advised in the premises,
finds that there is a genuine issue as to material facts in this matter
and it is
ORDERED AND ADJUDGED that the Motion for Summary Judgment
shall be and it is hereby denied.
