DAIRY FARM LEASE4tg2403
THIS LEASE is made this ~c1 day of December, 1979, between
CLAUDE T. DAVIS and JAMES L. DAVIS ("LESSORS"), and FRANCISCO J.
HERNANDEZ, MELVIN G. GREELEY and EDWARD E. STUART ("LESSEES"). _
W I T N E S S E T H:
LESSORS hereby lease to LESSEES, and LESSEES hereby lease
from LESSORS, that certain real property ("the premises"), situate, lying
and being in the County of St. Lucie, State of Florida, more particularly
described in Exhibit "A" (legal description) attached hereto and made a
part hereof .
This lease includes all the above-described land, the dwellings,
the sheds, main milking barn, cow pens and all other improvements thereon,
that certain equipment more particularly set forth on Exhibit "B" (inventory)
attached hereto and made a part hereof, and out buildings thereon.
The term of this lease is five years, beginning on the ~
day of December, 1979, and ending on the ~ ~ day of December, 1984
{together with Options provided in Paragraph 17, infra) for which LES-
! SEE agrees to pay to LESSOR an annual rent of SIXTY THOUSAND
DOLLARS 060,000.00), payable ;15,000.00 each quarter-annual period
on the first day of the first month of each such quarter in advance, at
the office of LESSOR or at such other place as LESSOR may designate
from time to time, in writing.
It is further agreed as follows:
1. POSSESSION AT BEGINNING OF TERM AND USE OF PREM-
ISES: LESSORS shall deliver possession to LESSEES at the beginning of
the term of this lease. LESSEES shall use the premises for the operation
of a dairy farm and/or other related agricultural purpose. Any other
use shall require prior written approval by LESSORS which will not be~
unreasonably withheld.
2. QUIET ENJOYMENT, ETC LESSORS covenant and repre-
sent that LESSORS have full right, title, power and authority to make, exe-
cute and deliver this lease. LESSORS covenant that so long as LESSEES
