HomeMy WebLinkAbout0218 • .v keep and perform the terms and covenants herein contained by LESSEES to be kept and performed, LESSEES shall have quiet, continuous and undis- turbed possession of the premises. LESSORS warrant that the milking barn, milking stable or parlor, cow pens, milkhouse or room, toilet, water sup- ply, etc. upon the premises are,. as of date hereof, in full compliance with the requirements of Rule SD-1.07 Rules, Florida Department of Agriculture and Consumer Services as determined according to the last inspection made by said department. 3. MAINTENANCE AND REPAIR BY LESSEES: LESSEES shall take good care of the premises including all improvements thereon and shall keep the improvements that LESSEES actually use in their existing working order and condition; and at the expiration or termination of the term, LESSEES shall surrender and deliver peaceable possession of the premises to LESSORS as LESSORS' property, in their existing condition and repair and free of liens, if any, for maintenance and repair work done by LESSEES, normal wear and tear excepted. 4. MAINTENANCE AND REPAIR: LESSEES shall be entitled to receive a credit of up to $40,000.00 against rent payable hereunder for improvements which LESSEES make to the premises and also for repair of sheds and the main milking barn, upon completion of such improvements and repairs and the presentation to LESSORS by LESSEES of the invoices or contract forms and completion certificates covering the same which properly evidence the actual costs: Such credit shall be equal to actual expenditures, not to exceed $40,000.00. The only maintenance and repair obligation of LESSORS shall be the structure siding and roof of the Butler Building which LESSORS will be obligated to maintain in good condition during the term of this lease. If the roof of the stanchion barn is replaced during the term of this lease then the ~ cost of the new roof shall be prorated between LESSORS and LESSEES, according to the life-expectancy of the new roof with each. party being responsible for paying an amount proportional to its use of the new roof. 5. RIGHT OF LESSORS TO PERFORM LESSEES' COVENANTS: Should LESSEES fail to perform any act required to be made or performed hereunder, and such failure to perform is not corrected or corrective -2 81 ~4K~ PAGE 2~.8
